The one-time maternity allowance regime for expatriate male employees

Faro Vietnam would like to update you on the following:
The maternity regime for expatriate employees participating in compulsory social insurance in Vietnam is specified at Article 7 of Decree 143/2018/ND-CP dated October 15, 2018. Accordingly, it is stipulated the conditions for entitlement the maternity benefits in accordance with Article 31 of the Law on Social Insurance, including the cases in which male employees contributing social insurance whose wives give birth.
Regarding the one-time allowance, Article 38 of the Law on Social Insurance stipulates that “in case of giving birth to a child but only the father participates in social insurance, the father is entitled to a one-time allowance equaling to 2 times of the basic salary at the month of giving birth to each child. ”.
Thus, in case a male employee who is an expatriate participating in social insurance whose wife gives birth but she does not participate in social insurance in Vietnam, he will be entitled to one-time allowance under Article 38 of the Law on Social Insurance.
