4.  Rights and Obligations Regarding Occupational Safety of Workers

Articles 6 and 17 stipulate the rights, obligations, and responsibilities of workers as follows:

  • Workers have the right to be guaranteed fair, safe, and hygienic working conditions. Employers are responsible for ensuring a safe and hygienic working environment throughout the work process.
  • Workers have the right to be provided with complete information about hazardous and harmful factors in the workplace and preventive measures, and to receive training and instruction on occupational safety and hygiene.
  • Workers have the right to receive occupational protection, healthcare, occupational disease examinations, and to have their occupational accident and disease insurance contributions paid by the employer.
  • Workers have the right to request that the employer assign them suitable work after stable treatment following an occupational accident or disease.
  • Workers have the right to refuse to perform work or leave the workplace while still receiving full pay and without being considered in violation of labor discipline if they perceive a serious risk of workplace accident threatening their life or health, but they must immediately report it to their manager for timely action.
  • Workers have the right to file complaints, denunciations, or lawsuits in accordance with the law.

5. Employer responsibilities under new safety compliance rules

According to Articles 7 and 16 of the law, the rights and obligations of employers in safety training regulations for newly hired manufacturing staff are stipulated as follows:

  • The employer has the right to require employees to comply with regulations, procedures, and measures to ensure occupational safety and health at the workplace.
